Terms of Service

By accessing or using Scanavigator (the “Service”) you agree to these Terms of Service (“Terms”) and to our Privacy Policy. If you do not agree, do not use the Service.

Scanavigator is an AI copilot for single-pilot flight operations, currently in pre-launch. The Service may include, over time, a pre-flight briefing feature, an in-flight voice assistant, and a post-flight debrief and logbook feature. Availability of any specific feature is not guaranteed.

Today the publicly-available Service includes a waitlist signup and a limited demonstration of the AI pre-flight briefing feature.

Because this cannot be repeated too often: the outputs of the Service are for informational and educational purposes only. They are not:

• An official weather briefing.
• An official NOTAM briefing.
• An air traffic control clearance or instruction.
• A substitute for approved flight-planning software or certified onboard equipment.
• A substitute for the pilot in command's training, currency, or judgment.

You must not use the Service as your only source of information for any flight-related decision. Before every flight you are required to cross-check current weather, NOTAMs, aircraft performance data, fuel calculations, and route considerations against official sources issued by the relevant aviation authority (the FAA, EASA, SACAA, or equivalent in your jurisdiction).

You agree not to:

• Use the Service in a way that violates any applicable law or aviation regulation.
• Attempt to reverse-engineer, decompile, or scrape the Service or its underlying APIs.
• Automate requests to the Service beyond what a reasonable human user would generate, or attempt to circumvent our rate limits.
• Use the Service to generate content that infringes anyone else's rights.
• Impersonate someone else when signing up or interacting with the Service.
• Attempt to disrupt or overload the Service.

Adding your email to the waitlist does not guarantee access to the full product when it launches. We may prioritize invites in any order and may cancel a waitlist entry at our discretion.

The current public demo is free. When the paid product launches, pricing tiers will be disclosed clearly on the site before you agree to any charges. These Terms will be updated to reflect billing arrangements at that time.

The Service, including its design, code, brand, and content that Scanavigator authors, remains the property of Scanavigator. You may share screenshots, briefings, and links for personal or non-commercial promotion of the Service.

Aircraft type names, ICAO codes, and public aviation data are property of their respective owners; we make no claim to them.

The Service integrates with third-party providers including aviationweather.gov, Supabase, Resend, Vercel, and — when configured — large language model providers such as Anthropic or OpenAI. Those providers have their own terms and privacy policies. We are not responsible for their availability or the accuracy of any information they return.

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied. To the maximum extent permitted by law, Scanavigator disclaims all warranties including merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and accuracy of any output.

To the maximum extent permitted by law, Scanavigator and its contributors shall not be liable for any indirect, incidental, consequential, special, or exemplary damages arising from your use of the Service, including but not limited to loss of data, damage to equipment or aircraft, personal injury, or loss of life.

Where liability cannot be excluded, our aggregate liability to you for any claim relating to the Service is limited to the greater of the amount you have paid us in the twelve months prior to the claim, or fifty US dollars (USD 50).

You agree to indemnify Scanavigator against any losses arising from your breach of these Terms or your misuse of the Service, including any claim brought by a third party as a result of your use of the Service in a manner that violates these Terms or any applicable law.

We may suspend or terminate your access to the Service at any time, for any reason, without notice. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnity, and governing law) will do so.

These Terms are governed by the laws of the Republic of South Africa. Any dispute will be brought before the competent courts of Cape Town, South Africa, unless we mutually agree in writing to a different forum.

We may update these Terms from time to time. The “Effective date” at the top will change when we do. If a change materially affects your rights, we will announce it via email to waitlist subscribers or via a notice on the site.
